1. Introduction

Welcome to TapKii (“we,” “our,” “us”).
TapKii provides software tools for self-employed providers, including online booking, customer management, business dashboards, training and certification programs (TapKii Academy), and related digital services.

By accessing or using TapKii, you agree to be bound by these Terms of Service.
If you do not agree, please do not use the Platform.

TapKii is operated by TapKii Technologies / 2645953 Alberta Inc. (Canada).

2. Definitions

  • “Platform” refers to all TapKii websites, mobile apps, dashboards, booking systems, Academy systems, and digital tools.

  • “User” or “You” includes both service providers (self-employed) and customers using the system.

  • “Provider” refers to a self-employed individual or business using TapKii to offer services.

  • “Customer” refers to people booking services through TapKii or related booking links provided by Providers.

  • “Content” refers to text, data, files, media, or materials uploaded to TapKii.

3. Eligibility

To use TapKii, you must:

  • Be at least 18 years old

  • Have the legal capacity to enter into contracts

  • Use the Platform in compliance with relevant laws in your region

  • For Providers: operate as a self-employed professional, not as an employee of TapKii

TapKii does not employ Providers.
TapKii is a software platform only, not a service provider, agency, or employer.

4. User Accounts

When creating an account, you agree to:

  • Provide accurate and up-to-date information

  • Maintain the confidentiality of your password

  • Be responsible for all activity under your account

We may suspend or terminate accounts for:

  • Fraud

  • Misuse

  • Violating the Terms

  • Illegal activities

5. Service Provider Responsibilities

Providers using TapKii agree that:

  • They are independent contractors (self-employed)

  • They are fully responsible for:

    • Service quality

    • Customer safety

    • Pricing, taxes, and business compliance

    • Insurance and licensing required in their region

  • TapKii only supplies software, not labor or staff

Providers must not:

  • Misrepresent qualifications

  • Provide unsafe or illegal services

  • Upload harmful or misleading content

6. Customer Responsibilities

Customers agree to:

  • Provide accurate booking information

  • Pay for services as required by the Provider

  • Respect cancellation policies

  • Use the Platform lawfully

TapKii is not liable for disputes between customers and Providers.
TapKii does not guarantee:

  • Service outcomes

  • Provider qualifications

  • Availability of any service

7. Payments & Fees

TapKii integrates payment systems such as Stripe to support Providers.
By using payment features, you agree to any fees charged by:

  • Stripe

  • TapKii subscription plans

  • Third-party processors

Providers are fully responsible for:

  • Declaring income

  • Paying taxes

  • Handling refunds or disputes with their customers

TapKii is not responsible for:

  • Payment failures

  • Chargebacks

  • Errors caused by third-party processors

8. TapKii Academy (Training & Certification)

When joining TapKii Academy, you agree that:

  • Training content is for educational purposes

  • Certification does not guarantee employment or licensing

  • TapKii is not responsible for local regulatory compliance for your profession

TapKii may update or discontinue courses at any time.

9. Content Ownership

You retain ownership of the content you upload.
However, by uploading content, you grant TapKii a worldwide, non-exclusive license to:

  • Store

  • Process

  • Display

  • Transmit

  • Use the content for platform functions

You must not upload:

  • Copyrighted content without permission

  • Harmful code

  • Illegal materials

10. Prohibited Activities

You agree not to:

  • Use TapKii for fraud or misrepresentation

  • Attempt to hack or disrupt the Platform

  • Copy or reverse-engineer TapKii software

  • Use TapKii to violate local laws

  • Create multiple fake accounts

  • Spam or misuse booking systems

Violation may result in immediate account termination.

11. Platform Availability

We aim to keep TapKii running smoothly, but we do not guarantee:

  • Uninterrupted service

  • No bugs or errors

  • No downtime

We may suspend services temporarily for:

  • Maintenance

  • System upgrades

  • Security reasons

12. Disclaimer of Liability

TapKii provides the Platform “AS IS” without warranties of any kind.

TapKii is not liable for:

  • Service provider actions

  • Customer behavior

  • Personal injury or damages during a service

  • Loss of data

  • Payment disputes

  • Business losses

  • Technical failures

Providers and Customers use TapKii at their own risk.

13. Indemnification

You agree to indemnify and hold TapKii harmless from any claims, damages, losses, or legal actions arising from:

  • Your use of the Platform

  • Your uploaded content

  • Services you provide or receive

  • Your violation of these Terms

14. Termination

We may close or suspend your account if you:

  • Violate the Terms

  • Misuse the Platform

  • Harm TapKii or other users

You may close your account at any time.
Subscription fees are non-refundable unless required by law.

15. Modifications to Terms

TapKii may update these Terms at any time.
When changes occur, we will:

  • Update the “Last Updated” date

  • Notify users where applicable

Continued use of TapKii means you accept the updated Terms.

16. Governing Law

For users in Canada: Alberta provincial law and Canadian federal law apply.
For users in the United States: Applicable state and federal laws apply.
For international users: Local laws apply in your region.

Any disputes must be resolved in the applicable courts.
